Standard Conditions for Grants

If your grant application is successful, you will be sent a contract.  This document sets out our contractual relationship with you for funding your activity.

The conditions of the contract are set out below for your information.  If you have any general questions about how this document applies to your activity, please contact your relevant project officer.


Standard Conditions

1. Interpretation

In this document:

  • ‘you’ means the person (individual) or organisation that is listed as the ‘Recipient’, or anyone officially representing this individual or organisation.
  • ‘we’, ‘us’ and ‘our’ means the State of Western Australia through the Department of Culture and the Arts (DCA).
  • words or phrases appearing under the heading "Your Details" have the same meaning as set out there.
  • reference to "Funded Activity" includes each permissible activity comprising or involved in such Funded Activity.
  • reference to a thing includes a part of that thing.
  • 'financially insolvent' means unable to pay debts as and when they fall due.

2. Use of the Grant

You agree to use the Grant only for the Funded Activity. For a Grant offered in response to your application, this will be the proposed activity you gave in your original application, summarised above in ‘Funded Activity’, and any changes which we may have requested or approved in writing.  You must carry out the Funded Activity in accordance with this document.

3. Accepting this Grant

a. You must accept the Grant by signing this document and sending it back to us. We will not make any payments until this has happened. If you are an organisation, the written acceptance must be signed by an officer authorised to sign for the organisation.

b. If we do not receive the signed acceptance of this document within three months after us sending it to you, our offer of a Grant will no longer be valid. If this happens, you will no longer be able to accept the Grant (unless we have agreed in writing to give you more time) and you will have to submit another application to be considered.

4. Acquitting the Grant

a. You agree to provide us, within thirteen weeks after the Completion Date or the end of this document (whichever occurs first), the following:

i) a detailed project report; and
ii) a statement of income and expenditure showing how the Grant was spent, duly certified by you or (if an organisation) the executive officer or equivalent,

This information must be provided to us on the acquittal form which can be sent to you in hard copy by contacting us on +61 8 9224 7310.

b. The Grant must be disclosed as a separate and identifiable item in the statement required under clause 4(a)ii) above.

5. Changes to Funded Activity

a. You must seek our approval in writing for any change/s:

i) to the Funded Activity, together with material changes to any budget or key personnel; and/or
ii) to the Commencement or Completion Dates of the Funded Activity.

b. We may alter or withdraw the Grant if we do not consider the change to be reasonable in relation to the Grant. You should not go ahead with any change until you have received our written approval for this change.

6. Acknowledgements

You agree to display and/or include in all promotional material and publications relating to the Funded Activity, the DCA logo combined with that of the Government of Western Australia logo.

7. Promotional Materials

You must forward copies of all promotional materials relating to the Funded Activity to us.

8. Information you need to provide to us

a. You must provide within fourteen days any information or documentation requested in writing by us which is relevant to the Funded Activity, the Grant or this document. Receipts for purchases or payments should be obtained and retained until you are formally advised by us that your acquittal is acceptable.

b. You must immediately inform us in writing if and when you are becoming, or are in danger of becoming, or have become, financially insolvent.

c. You must keep proper, properly detailed, accurate and up-to-date records relating to what activities in connection with the Funded Activity have been attempted and carried out together with all income and expenditure in connection with the Funded Activity.  We may inspect and take copies of those records with the giving of reasonable prior notice.

d. All information and documentation to be provided to us under this document must be accurate, complete, up-to-date and in no way deceptive or misleading.

9. Compliance with the law

You agree to comply with all applicable laws in undertaking the Funded Activity.

10. Breaching this document

a. We may end this document if you:

i) become financially insolvent; or
ii) breach any of the provisions of this document.

b. If we end this document under this clause 10 or 13, one or more of the following may (in our total discretion) apply:

i) you may have to pay back all of the Grant (or any part of the Grant we decide) regardless of how much you may have already spent; and
ii) we may stop any future payments.

c. If you breach any of the provisions of this document and we do not enforce one or more of our rights straight away, this does not mean that we will not do so in the future. We will give up our right to enforce this document only if we tell you in writing.

11. Other provisions

a. We are not obliged to provide, and nor should you assume that we will provide any further funding after this document comes to an end, and where the term of this contract exceeds 12 months, you acknowledge that any continuation of funding beyond a 12-month period is conditional upon us receiving sufficient finance through our normal sources to meet all of our previously contracted commitments.

b. The Freedom of Information Act 1992 (‘the Act’) applies to us. This means that any information you give us may be released to any person who asks for it under the Act.

12. Activities involving children

Where this Funded Activity involves contact with children, it is a condition precedent to this document and payment of the Grant that:

a. We receive the declaration attached to this document, signed by you or, in the case of an organisation, an authorised officer, attesting to his or her or the organisation's suitability to work with children.

b. You or your organisation receives a signed declaration in the form attached from all persons working on your or your organisation's behalf with children as part of the Funded Activity.  You must, whenever asked, provide evidence of compliance with this clause.


Logos & branding

All logos can all be downloaded from the DCA website.

As per your contract you must use the DCA logo in any printed or online materials associated with your funded activity.  You do not need to use the Lotterywest logo.  In all acknowledgement speeches, you should refer to the Department of Culture and the Arts.
